Parental Rights
In cases where you already have children, the legislation is clear-cut. Following your transition, neither your parental rights nor obligations nor your legal relationship with your child will change, nor will your position as the child’s parent. Thus, if you were a man and later decided to become a woman, you would still have all the legal rights associated with being your child’s father.
While you will have legal rights, it might not reflect the name or status you have selected for your family.
There are undoubtedly a lot of issues you will have concerning your legal parenthood for any new child if you have already transitioned and are looking to start a new family.
Regretfully, there is currently no explicit legal framework that addresses transgender parents who have transitioned and then become naturally pregnant. Based on past situations, it appears that you can still rely on the parenting status that you would have had if you had been a different gender. Therefore, even though you are a woman, you may still be able to legally claim to be the child’s “father” if you are still able to generate sperm after having had a gender transformation. We believe that the existing legal position is insufficient, and the Scottish Government is presently consulting on the legislation.
There is some statutory provision for better legal results for such families when assisted conception comes into play.
